Shri D.P. Gairola, Member-Law and Chairman-Incharge

Shri D.P. Gairola was born on 20th July, 1959 in Vill- Bhangla Distt. Tehri Garhwal (Uttarakhand). He has done B.A. and LL.B. from Garhwal University and LL.M. from Allahabad University. He joined Judicial Service in the year 1986 and served at various post in Uttar Pradesh as Munsif Magistrate, Judicial Magistrate 1st Class, A.C.J.M Railway Chief Judicial Magistrate and Civil & Asstt. Sessions Judge. And in the year 2000 when Uttarakhand State came into existence he opted Uttarakhand state. He was promoted in H.J.S. Cadre in the year 2003 and served as Addl. Distt. & Session Judge and Special Judge C.B.I. He served as Secretary, Lokayakta, as Distt. & Session Judge Rudraprayag, Chamoli, Pithoragarh, Champawat, Haridwar and Uttarkashi. He also served as Principal Secretary (Law), Principal Secretary Legislative and Parliamentary affairs and Principal Secretary Legislative assembly. He served as Registrar General in the Hon’ble H.C. Nainital and also served as Administrator General Govt. of Uttarakhand. And before Joining this institution was again serving as Principal Secretary Law Cum L.R. and Principal Secretary Legislative and Parliamentary affairs. He was sworn in as Member (Law), Uttarakhand Electricity Regulatory Commission (UERC) on 12th April, 2019.

Er. M.K. Jain is a dynamic Technocrat and an expert Power Engineer with over 38 years of diverse experience and expertise in the allied areas of Electricity Generation, Transmission and Distribution of the respective Power Sector’s of Uttar Pradesh and Uttarakhand since 1980. He has an in-depth specialisation in the Regulatory functionalities and regulations since the inception of the Uttarakhand Electricity Regulatory Commission (UERC), Dehradun (2002). He joined as Member (Technical), UERC on 12th April, 2019. Prior to joining the Commission, he served as Director (Project) from July 2015 to November 2018 at the Uttarakhand Power Corporation Limited (UPCL), Dehradun. He also worked as Managing Director, UPCL from 30.11.2016 to 07.04.2017. He was awarded a B.E. Hons. (Electronics) degree from the Madan Mohan Malviya University of Technology- MMMUT, Gorakhpur (1979) and was pursuing Master of Engineering in Solid- State Electronics from the Indian Institute of Technology-IIT, Roorkee (1980) before joining UPSEB. During the worst ever disaster of June 2013 in Uttarakhand he, as Chief Engineer Garhwal, commanded the restoration process by camping at different sites for more than one & half months, till the supply restored. Tripping free Maa Nanda Devi-Raj Jaat Yatra, Kumbh of Uttarakhand, is also important to mention as an achievement during his tenure. Further UPCL was accredited as amongst the Top DisComs of India with the Annual A+ rating(s) during the FY 2015-16 and FY 2016-17 consecutively with an All- India Ranking as the 4th DisCom and Uttarakhand as the 2nd State after Gujarat country-wide in the State Distribution Utilities Annual Integrated Rating Report by the Ministry of Power Government of India, New Delhi is also worth mentioning.

Section 86 of the Electricity Act, 2003 provides that the State Commission would discharge the following functions:
Determine the tariff for generation, supply, transmission and wheeling of electricity, wholesale, bulk or retail, as the case may be, within the State: Provided that where open access has been permitted to a category of consumers under section 42, the State Commission shall determine only the wheeling charges and surcharge thereon, if any, for the said category of consumers.
Regulate electricity purchase and procurement process of distribution licensees including the price at which electricity shall be procured from the generating companies or licensees or from other sources through agreements for purchase of power for distribution and supply within the State.
Facilitate intra-State transmission and wheeling of electricity.
Issue licenses to persons seeking to act as transmission licensees, distribution licensees and electricity traders with respect to their operations within the State.
Promote cogeneration and generation of electricity from renewable sources of energy by providing suitable measures for connectivity with the grid and sale of electricity to any person, and also specify, for purchase of electricity from such sources, a percentage of the total consumption of electricity in the area of a distribution licensee.
Adjudicate upon the disputes between the licensees and generating companies and to refer any dispute for arbitration.
Levy fee for the purposes of this Act.
Specify State Grid Code consistent with the Grid Code specified under clause (h) of sub-section (1) of section 79.
Specify or enforce standards with respect to quality, continuity and reliability of service by licensees.
Fix the trading margin in the intra-State trading of electricity, if considered, necessary. Discharges such other functions as may be assigned to it under this Act. Under the Electricity Act, 2003 the Commission shall also advise the State Government on all matters pertaining to: Promotion of competition, efficiency and economy in activities of the electricity industry; Promotion of investment in electricity industry; reorganization and restructuring of electricity industry in the State Matters concerning generation, transmission, distribution and trading of electricity or any other matter referred by the Government.

The Appropriate Commission shall have the powers to pass such interim order in any proceeding, hearing or matter before the Appropriate Commission, as that Commission may consider appropriate.
The Appropriate Commission may authorize any person, as it deems fit, to represent the interest of the consumers in the proceedings before it..
